Terms of service
Terms & Conditions
Last updated: 5 September 2026
These Terms & Conditions ("Terms") govern your use of femlibre.au and purchases made from FemLibre.
The website and online store are operated by FemLibre Pty Ltd (ABN 19 685 453 927) ("FemLibre", "we", "us" or "our").
By using our website or placing an order with FemLibre, you agree to these Terms. Please read them before making a purchase.
Nothing in these Terms excludes, restricts or modifies any right or remedy that cannot lawfully be excluded, including rights under the Australian Consumer Law.
1. About FemLibre
FemLibre is an Australian period-care business providing menstrual products through our online store.
Our current store operates on a one-off purchase model. Purchasing a FemLibre box does not enrol you into a paid subscription or authorise recurring charges unless we clearly introduce such a service in the future and you expressly choose to participate.
Our store currently accepts orders for delivery within Australia only.
2. Products
We aim to ensure product descriptions, photographs, variants, quantities and other information displayed on our website are accurate and current.
The contents of each product are described on the applicable product page at the time of purchase.
Product or retail packaging may occasionally differ from photographs displayed on our website due to manufacturer packaging changes or other reasonable variations. Any product supplied will nevertheless be materially consistent with the product ordered, subject to your rights under the Australian Consumer Law.
We will not substitute a product or variant you have ordered with a materially different product without your agreement.
3. Product availability
All products are subject to availability.
Where an item is shown as sold out, it will ordinarily be unavailable to purchase until additional stock becomes available.
We may offer products for pre-order from time to time. Where we do, the product will be identified as a pre-order and we will provide available information about the expected dispatch timeframe.
Expected pre-order dates are estimates and may be affected by circumstances outside our reasonable control. If a material delay occurs, we will communicate with affected customers and provide any remedy required by applicable law.
4. Pricing
All prices are displayed in Australian dollars (AUD).
Prices displayed on our website apply at the time an order is placed, subject to correction of genuine errors.
Applicable delivery charges are displayed during the purchasing process before you complete payment.
Where GST applies to a supply, prices will be treated in accordance with applicable Australian GST requirements. Certain menstrual products supplied by FemLibre may be GST-free under Australian tax law.
FemLibre may change product prices or delivery charges from time to time. A price change will not retrospectively alter the agreed price of an order we have already accepted, except where required or permitted by law.
5. Pricing and website errors
We take reasonable care to ensure pricing and product information is accurate.
Occasionally, genuine errors may occur, including incorrect pricing, product descriptions, stock levels or technical errors.
If we identify an obvious or genuine error affecting an order, we may contact you to explain the issue and, where reasonably necessary, cancel the affected order and provide a full refund of amounts paid for the cancelled goods.
Nothing in this section permits FemLibre to engage in misleading or deceptive conduct or otherwise limits your rights under applicable law.
6. Placing an order and payment
Orders are placed through our online checkout.
Full payment is generally required at the time you place your order.
Payments are currently processed through payment methods made available through our Shopify store, including Shopify Payments. Additional payment providers may be introduced from time to time.
Payment information is handled in accordance with the relevant payment provider's terms and privacy practices and our Privacy Policy.
Submitting payment and receiving an automated order confirmation means we have received your order. We may subsequently need to cancel an order in limited circumstances, including where:
-
stock is unexpectedly unavailable;
-
there is an obvious pricing or website error;
-
we cannot deliver to the address provided;
-
payment cannot be successfully verified;
-
we reasonably suspect fraud, misuse or unauthorised commercial resale; or
-
we are otherwise unable or not permitted to fulfil the order.
If we cancel an order after payment has been successfully taken, we will refund the amount paid for the cancelled order to the original payment method, unless another method is agreed with you.
We will exercise any cancellation right reasonably and consistently with applicable Australian law.
7. Order limits and resale
FemLibre products sold through our consumer store are intended for personal or end-user use unless we agree otherwise.
We may apply reasonable purchase limits or cancel unusually large or repeated orders where we reasonably believe this is necessary to manage limited stock, prevent fraud or misuse, or prevent unauthorised commercial resale.
FemLibre products must not be purchased from our consumer store for commercial resale without our prior written permission.
For wholesale, partnership or commercial enquiries, please contact hello@femlibre.au.
8. Promotions and discount codes
FemLibre may offer promotional prices, discount codes, competitions, giveaways or other offers from time to time.
Additional conditions, eligibility requirements or expiry dates may apply to a particular promotion and will be communicated with that promotion.
Unless otherwise stated, promotional offers:
-
cannot be redeemed for cash;
-
may be limited to one use per customer or order;
-
may be subject to product or stock restrictions; and
-
may be withdrawn or corrected where affected by fraud, misuse or genuine technical error, subject to applicable law.
9. Shipping and delivery
FemLibre currently ships within Australia using Australia Post.
Our current shipping charges and further delivery information are set out in our Shipping & Delivery Policy and displayed where applicable during checkout.
We generally aim to dispatch in-stock orders within 3–4 business days after an order is placed and payment is confirmed.
Dispatch time is the period before the parcel is provided to Australia Post. It is separate from Australia Post's delivery timeframe.
Where tracking is available for the applicable Australia Post service, tracking information will be provided to the customer.
Delivery estimates are estimates only and may be affected by Australia Post operations, peak periods, weather, natural disasters, incorrect addresses and other circumstances outside FemLibre's reasonable control.
Nothing in this section limits any rights you may have where goods are not supplied within an agreed or reasonable timeframe.
10. Delivery addresses
You are responsible for providing a complete and accurate delivery address when placing an order.
If you notice an error after ordering, contact hello@femlibre.au as soon as possible.
We will make reasonable efforts to correct an address before dispatch where operationally possible, but we cannot guarantee that changes can be made after an order has entered fulfilment.
If an order is returned to us because an incorrect or incomplete address was supplied by the customer, we may require payment of the reasonable cost of re-delivery before sending the parcel again.
You will not be responsible for additional delivery costs caused by an error made by FemLibre.
11. Lost, delayed or damaged deliveries
If your parcel appears to be significantly delayed, lost or damaged in transit, please contact FemLibre at hello@femlibre.au.
We may investigate the matter with Australia Post and may request reasonable information from you to assist with that investigation.
Where FemLibre is responsible for providing a remedy under the Australian Consumer Law or other applicable law, we will deal with the matter directly with you. You will not be required to pursue the manufacturer or delivery provider instead of FemLibre where FemLibre has a legal responsibility to provide the remedy.
Further information is available in our Shipping & Delivery Policy and Returns & Refunds Policy.
12. Changes and cancellations before dispatch
If you change your mind, order the wrong variant or need to cancel an order, contact hello@femlibre.au as soon as possible.
Where your order has not yet entered fulfilment or been dispatched, we will make reasonable efforts to accommodate the requested change or cancellation.
We cannot guarantee that an order can be changed or cancelled once processing or fulfilment has commenced.
Any rights you have under the Australian Consumer Law remain unaffected.
13. Change-of-mind returns
Because FemLibre sells menstrual and personal-care products, we do not generally accept returns or exchanges for change of mind once an order has been dispatched.
This includes where you ordered the correct product but later decide you no longer want or need it.
This change-of-mind policy does not limit your rights where a product is faulty, unsafe, damaged, incorrectly supplied, materially different from its description or otherwise fails to comply with a consumer guarantee under the Australian Consumer Law.
Please see our Returns & Refunds Policy for further information.
14. Australian Consumer Law
Our goods come with consumer guarantees that cannot be excluded under the Australian Consumer Law.
Among other things, goods supplied to consumers must be of acceptable quality, be fit for applicable purposes, match their description and satisfy other consumer guarantees imposed by law.
Where a product fails to meet an applicable consumer guarantee, you may be entitled to a remedy such as repair, replacement, refund or compensation depending on the circumstances and seriousness of the failure.
Nothing in these Terms, our Returns & Refunds Policy or any other FemLibre policy is intended to exclude or restrict these rights.
If you believe there is a problem with a product purchased from FemLibre, contact hello@femlibre.au and we will assess the issue and provide an appropriate remedy where required.
15. Product safety and use
Menstrual products should be used in accordance with the instructions, warnings and guidance supplied by the product manufacturer.
Please read and follow all product packaging and safety information before use.
Information provided by FemLibre through our website, marketing, customer service or other communications is general information and is not intended to constitute medical advice, diagnosis or treatment.
If you experience a health concern, adverse reaction or other medical issue, seek appropriate medical assistance.
You may also report product concerns to FemLibre at hello@femlibre.au. We may liaise with the relevant manufacturer or supplier, including Cottons, when investigating product quality or safety issues.
Where FemLibre has an obligation to provide a consumer remedy, our involvement of a manufacturer or supplier does not remove that obligation.
16. Returns and refunds
Returns, refunds, replacements and other remedies are managed in accordance with our Returns & Refunds Policy and applicable Australian law.
Where a refund is payable, we will generally return funds to the original payment method unless another method is agreed with you or otherwise required by law.
Nothing in our policies restricts remedies available under the Australian Consumer Law.
17. Customer accounts
Where customer-account functionality is available, you may have the option to create an account with FemLibre.
You are responsible for maintaining the confidentiality and security of your login credentials and for notifying us if you reasonably suspect unauthorised access to your account.
We may suspend or restrict access to an account where reasonably necessary to protect customers, FemLibre or our systems from suspected fraud, misuse or security threats.
Personal information associated with customer accounts is handled in accordance with our Privacy Policy.
18. Website availability
We aim to keep femlibre.au available and functioning correctly, but we do not guarantee uninterrupted or error-free access.
We may temporarily restrict, suspend or modify website functionality for maintenance, security, technical or operational reasons.
We will not be responsible for interruptions outside our reasonable control except to the extent liability cannot lawfully be excluded.
19. Intellectual property
Unless otherwise stated, content made available through femlibre.au — including FemLibre branding, logos, written content, graphics, website design and original imagery — is owned by or licensed to FemLibre.
Third-party product names, trademarks, packaging and imagery remain the property of their respective owners.
You may use our website for personal and lawful purposes.
You must not reproduce, commercially exploit, distribute or materially modify FemLibre-owned content without our permission except where permitted by law.
20. Acceptable use
You must not knowingly use our website to:
-
engage in unlawful or fraudulent activity;
-
interfere with the operation or security of the website;
-
attempt to gain unauthorised access to systems or accounts;
-
transmit malicious code;
-
misuse promotions or payment systems; or
-
infringe the rights of FemLibre or another person.
We may take reasonable steps to restrict access where necessary to protect the website, customers or our business.
21. Third-party services
Our website and store rely on third-party services, including Shopify, payment providers, Australia Post and other technology providers.
Links to third-party websites or services may also be provided for convenience.
Third-party services may be subject to their own terms and privacy policies.
To the extent permitted by law, FemLibre is not responsible for independent third-party websites or services that are outside our control.
22. Privacy
Personal information is handled in accordance with our Privacy Policy, available at femlibre.au.
Our Privacy Policy explains how we collect, use, disclose and protect personal information and how you can contact us about privacy matters.
23. Events outside our reasonable control
FemLibre will not be responsible for delay or failure caused solely by circumstances outside our reasonable control to the extent permitted by law.
Such circumstances may include natural disasters, severe weather, transport disruption, postal disruption, widespread telecommunications or technology failures, government action and other events we could not reasonably prevent.
Where such an event materially affects an order, we will take reasonable steps to communicate with affected customers and manage the order appropriately.
This section does not exclude any rights or remedies that cannot lawfully be excluded.
24. Liability
To the maximum extent permitted by law, FemLibre excludes liability that may lawfully be excluded and does not accept liability for loss caused by circumstances outside our reasonable control or by a customer's misuse of a product contrary to supplied instructions or warnings.
However, nothing in these Terms excludes, restricts or modifies:
-
consumer guarantees under the Australian Consumer Law;
-
liability that cannot lawfully be excluded or limited; or
-
any other statutory right or remedy that cannot lawfully be excluded.
Where the Australian Consumer Law or another law gives you rights or remedies, those rights and remedies prevail over any inconsistent provision of these Terms.
25. Changes to these Terms
We may update these Terms from time to time to reflect changes to our business, products, website, operations or legal obligations.
The current Terms will be published on femlibre.au and will display the date they were last updated.
Changes will generally apply prospectively and will not retrospectively alter the agreed terms of an existing order except where required or permitted by law.
Where a change is significant and it is appropriate to do so, we may take reasonable steps to bring it to the attention of affected customers.
26. Severability
If any provision of these Terms is found to be invalid, unlawful or unenforceable, that provision will be read down to the extent necessary where possible.
If it cannot be read down, it will be severed without affecting the remaining provisions.
27. Governing law
These Terms are governed by the laws applicable in Victoria, Australia.
You and FemLibre submit to the courts and tribunals having jurisdiction in Victoria and any other courts or tribunals that have jurisdiction under applicable Australian law.
Nothing in this section limits any rights a consumer may have regarding where a claim may lawfully be brought.
